These Terms and Conditions ("Terms") govern your access to and use of the Peso Cash Loan mobile application and related services ("App" or "Service"), operated by MAKATI LOAN, INC. ("Company", "we", "us", or "our"), a lending company duly registered with and licensed by the Securities and Exchange Commission (SEC) of the Philippines (SEC Registration No. CS201917209) under a valid Certificate of Authority to operate as a lending company.
Please read these Terms carefully. By downloading, registering for, accessing, or using the App, you ("you", "User", or "Borrower") agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the App.
1. Acceptance of Terms
By creating an account or submitting a loan application, you confirm that you have read, understood, and agreed to these Terms, the Privacy Policy, and any specific loan agreement, disclosure statement, or promissory note presented to you in-app at the time of borrowing. These Terms, together with each loan's disclosure statement, constitute the entire agreement between you and the Company.
Where there is any conflict between these Terms and the specific disclosure statement or loan agreement for a particular loan, the terms of that loan-specific document shall prevail for that loan.
2. Eligibility
To be eligible to use the Service, you must:
- Be a Filipino citizen residing in the Philippines;
- Be at least twenty-one (21) years old and not more than sixty (60) years old at the time of application;
- Possess a valid government-issued identification document;
- Maintain an active Philippine mobile number and a bank account or e-wallet (such as GCash or Maya) in your own name; and
- Have the legal capacity to enter into a binding contract.
We reserve the right to verify your eligibility and to approve or decline any application at our sole discretion.
3. Account Registration
You must provide accurate, current, and complete information during registration and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- You may register only one (1) account and must not use another person's identity or information;
- You must notify us immediately of any unauthorized use of your account or any security breach;
- We are not liable for any loss arising from your failure to safeguard your credentials.
4. Loan Application and Approval
Submitting a loan application through the App does not guarantee approval. All applications are subject to our credit assessment, identity verification (KYC), and risk evaluation. We may request additional documents or information at any time.
Your approved loan amount, term, applicable interest rate, and fees are determined individually based on your assessment and are presented to you for review and acceptance before the loan is finalized. No loan is binding until you have expressly accepted its disclosure statement within the App.
5. Interest, Fees and Charges
In accordance with Republic Act No. 3765 (the Truth in Lending Act) and applicable SEC and Bangko Sentral ng Pilipinas (BSP) regulations, all costs associated with your loan are fully disclosed to you before you accept it. These may include:
- Interest — calculated at the applicable daily or periodic rate shown in your disclosure statement (rates start from as low as 0.05% per day);
- Processing or service fees — if any, disclosed as a fixed amount or percentage prior to acceptance;
- Penalties for late payment — if any, as set out in Section 7 and your disclosure statement.
There are no hidden charges. The total amount payable, the schedule of payments, and the effective interest rate are always shown to you in the App before you confirm a loan. You may repay your loan early at any time with no prepayment penalty.
6. Repayment
You agree to repay your loan in full, including any applicable interest and fees, on or before the due date(s) specified in your disclosure statement. Repayments may be made through the channels made available in the App (such as bank transfer, e-wallet, or accredited payment partners).
- It is your responsibility to ensure sufficient funds and to settle on time;
- Payments are applied in the order set out in your loan agreement (typically fees, then interest, then principal);
- You should retain proof of payment until your loan reflects as fully settled in the App.
7. Late Payment and Default
If you fail to pay any amount when due, your loan may be considered past due or in default. Consequences may include:
- Late payment penalties and/or default interest, where disclosed in your loan agreement;
- Reporting of your repayment status to credit bureaus, including the Credit Information Corporation (CIC), which may affect your credit standing;
- Suspension of your eligibility for future loans;
- Lawful collection activity conducted in accordance with Section 8.
Borrow responsibly. Only borrow what you can comfortably repay. Late or non-payment may affect your credit standing and your ability to borrow in the future.
8. Collection Practices
In line with SEC Memorandum Circular No. 18, Series of 2019 and Republic Act No. 11765 (the Financial Products and Services Consumer Protection Act), we are committed to fair and lawful collection. In the event of overdue amounts, we commit that:
- We will not contact persons in your phone's contact list for collection purposes;
- We will not use threats, harassment, profanity, or abusive, obscene, or misleading communications;
- We will not publicly disclose or "shame" you regarding your debt;
- Collection will be carried out only through authorized and properly identified personnel during reasonable hours;
- You may report abusive collection practices to the SEC.
9. User Obligations and Prohibited Conduct
You agree that you will not:
- Provide false, misleading, or fraudulent information or documents;
- Use the App for any unlawful, fraudulent, or money-laundering purpose;
- Impersonate another person or use another person's identity, ID, or financial accounts;
- Attempt to gain unauthorized access to, interfere with, reverse-engineer, or disrupt the App or its security;
- Use bots, scrapers, or automated means to access the Service.
Violation of these obligations may result in immediate suspension or termination of your account and may expose you to civil or criminal liability.
10. Data Privacy
Your use of the App involves the collection and processing of personal data, which we handle in accordance with Republic Act No. 10173 (the Data Privacy Act of 2012) and our Privacy Policy. By using the Service, you consent to such collection and processing as described in the Privacy Policy, which forms an integral part of these Terms.
11. Intellectual Property
All content, trademarks, logos, software, and materials available through the App are owned by or licensed to the Company and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works without our prior written consent.
12. Disclaimers and Limitation of Liability
The App is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the App's availability, reliability, or fitness for a particular purpose.
To the extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from service interruptions, delays, or events beyond our reasonable control. Nothing in these Terms limits any liability that cannot be excluded under Philippine law.
13. Suspension and Termination
We may suspend or terminate your access to the App, with or without notice, if you breach these Terms, provide false information, engage in fraudulent or unlawful activity, or where required by law or regulation. Termination does not relieve you of any outstanding repayment obligations, which survive termination.
You may stop using the App at any time; however, you remain liable for any outstanding loan balance until it is fully settled.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines. Any dispute arising out of or relating to these Terms or your use of the App shall first be addressed through our internal complaints and consumer assistance mechanism under RA 11765.
If a dispute cannot be resolved amicably, it shall be referred to the appropriate regulator (such as the SEC) or to the exclusive jurisdiction of the proper courts of Makati City, Philippines, to the extent permitted by law.
15. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or regulatory guidance. We will notify you of material changes through the App or via email at least seven (7) days before they take effect. Your continued use of the App after the effective date constitutes acceptance of the updated Terms.
